Texas Gun Rights Statement on HB 1894 Hearing in House Select Committee on Community Safety

Chris McNutt, President of Texas Gun Rights, testified IN FAVOR of HB 1894 early this morning in the Texas House Committee on Community Safety. HB 1894 would effectively ban “Red Flag” gun confiscation laws in the state of Texas.

“Red Flag” gun confiscation laws seek to confiscate firearms from individuals in a manner that supersedes due process or any real precedent for doing so.

“Red Flag” gun confiscation laws infringe on at least three rights protected by the U.S. Constitution:

  1. The Fourth Amendment, protecting people against unreasonable search and seizure.
  2. The 5th Amendment, which says someone shall not be deprived of life, liberty, or property, without due process of law.
  3. Second Amendment, which states A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be Infringed.

So far this session, Texas Republican Leadership has promoted gun control through the dangerous expansion of NICS Gun Ban Registry Expansion bills, despite Republican voters overwhelmingly rejecting the gun control lobby, as evident by Robert “Beto” O’Rourke’s general election loss to Governor Greg Abbott last November.

HB 1894 goes on the offensive, protecting the rights of all Texans from dangerous “Red Flag” gun confiscation laws.
