NAGR Sounds Alarm About New “Red Flag” Gun Confiscation Office

The Department of Justice launched its National Extreme Risk Protection Order (ERPO) Resource Center to offer assistance to law enforcement officials, social services providers, and others who implement “Red Flag” Gun Confiscation laws.

“Red Flag” laws permit judges to strip individuals of their ability to possess firearms based on a mere accusation, without any due process.

The creation of this office stems from the Bipartisan Safer Communities Act, which was passed by Congress and signed into law the summer of 2022.

U.S. Senator John Cornyn (R-TX) has faced much backlash since the passing of this bill and the creation of this “Red Flag” Gun Confiscation office for his role as being the lead negotiator in getting 15 Republican Senators to join Democrats in passing the BCSA.

Shortly after the announcement of the creation of this office, the National Association for Gun Rights issued a statement:

“Red flag laws are inherently a violation of the Second, Fourth, Fifth, Sixth, and Fourteenth Amendments because they allow for the confiscation of legal firearms from law-abiding citizens without due process based on anonymous accusations. Thus, they have no place in American Jurisprudence.”

“President Joe Biden and the DOJ will use the center to continue their abuse of the constitutional rights of all Americans.”

21 states, along with the District of Columbia, have some form of “Red Flag” laws on the books already, and this office aims to grow that number.

The National Association for Gun Rights vehemently opposes any sort of “Red Flag” Gun Confiscation law.
